These Terms govern access to DealerGain’s public websites and consumer communications. Dealership subscriptions are also governed by the applicable signed DealerGain dealer agreement. By using the site, you agree to these Terms.
DealerGain services
DealerGain supplies software used by independent dealerships to manage inventory, websites, leads, appointments, communications, and related operations. Participating dealerships are independent businesses. Vehicle availability, pricing, financing, warranties, representations, and sales are controlled by the applicable dealership, not DealerGain.
SMS messaging terms
If you expressly opt in, DealerGain or the dealership identified in the opt-in may send conversational messages about your vehicle inquiry, requested follow-up, availability, and appointments. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase.
You may opt out at any time by replying STOP. After opting out, you may receive one confirmation and no further texts for that messaging program unless you provide new consent. Reply HELP for help or contact the dealership associated with your inquiry. Mobile information and consent are handled under our Privacy Policy.
DealerGain demo and support text program
Separately from dealership customer messages, DealerGain offers its own optional demo and support text program at (425) 961-9077. If you opt in through our demo/support form, messages concern your requested DealerGain software demo, scheduling and reminders, and support requests. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to unsubscribe or HELP for help. For support, email manager@dealergain.com. Carriers are not liable for delayed or undelivered messages. This program does not send dealership vehicle solicitations. Text service is pending carrier approval.
Email communications
Emails may include responses to requests, account or security notices, appointment information, and—where permitted—promotional information. Use the unsubscribe mechanism in applicable emails to stop promotional email. Transactional or legally required notices may continue.
Acceptable use
You may not misuse DealerGain, probe or disrupt its security, access another person’s information, submit false or unlawful material, interfere with service operation, or use the service in violation of law or third-party rights.
No financing or legal advice
DealerGain is not a lender, credit bureau, automobile dealer, law firm, or financial adviser. Submitting a finance application does not guarantee approval or terms. Dealerships and financing sources are responsible for their decisions and required disclosures.
Disclaimers and limitation
To the extent permitted by law, public services are provided “as is” and “as available.” DealerGain does not warrant uninterrupted operation or the accuracy of dealership-provided inventory and offer information. DealerGain will not be liable for indirect, incidental, special, consequential, or punitive damages arising from public-site use. Rights that cannot legally be waived are not affected.
Changes and contact
We may update these Terms by posting a revised effective date. Continued use after an update constitutes acceptance where permitted. Questions may be submitted through the DealerGain contact form.
